When these terms apply.
These terms apply when you use the Kaizen website or Mara. They do not replace a signed agreement for consulting, development, implementation or support services.
By using the website or starting a conversation with Mara, you agree to these terms and our Privacy Policy. If you use the website for a company or another organisation, you confirm that you have authority to provide the information you enter.
What the website means.
The website gives general information about Kaizen, our approach, our experience and the systems we work with. It is not a binding quote, project commitment or guarantee that the same approach or result will suit another business.
Nothing on the website is legal, financial, medical, employment, cybersecurity or other professional advice. You still need to understand your own obligations, risks and operating environment.
Kaizen services use a separate agreement.
Paid work is governed by the proposal, statement of work or other written agreement signed for that engagement. If these website terms conflict with that agreement, the signed agreement applies to the service.
Starting a Mara conversation does not require you to buy anything. It also does not require Kaizen to accept or perform a project.
Mara helps you think. She does not decide for you.
Mara is Kaizen’s guided AI planning tool. She helps you examine one piece of work, identify what is still uncertain and prepare possible next steps.
Mara responds only to the information available in the conversation. She may misunderstand the context or produce incomplete, inaccurate or outdated information. A product she suggests may also have changed its features, pricing or availability.
Treat the completed plan as a useful starting point.
Check the facts, product details, risks and human approvals before changing a live process or system. You remain responsible for deciding what is safe, lawful and appropriate for your business.
What you can safely enter.
You keep any rights you already have in information you provide. You confirm that you have authority to provide it and that doing so does not expose another person’s personal information or another party’s confidential material without permission.
Do not enter passwords, access keys, customer records, health information or other sensitive information. Do not use Mara for an emergency or a decision where an incorrect response could cause serious harm.
You allow Kaizen and its service providers to process what you enter only as needed to run Mara, prepare and deliver the plan, protect the service and follow up with you. Our Privacy Policy explains that flow.
Your email, plan and Plan ID.
When you start Mara, you agree that Kaizen may use your contact details to email the completed plan, contact you about the brief and discuss whether Kaizen can help. Your work email is not included in the AI model request.
If storage succeeds, a private Plan ID can reopen the plan without an account. It does not reopen or resume the conversation. Anyone with the ID can open the plan, so you are responsible for keeping it private.
Plan access expires after 30 days. Availability is not guaranteed and the Plan ID is not a permanent records service. Keep or copy the on-screen plan if you need it later.
How you can use the plan.
Subject to applicable law and third-party rights, you may copy, adapt and use your completed Mara plan inside your business. Kaizen does not claim ownership of your business information.
The website, Kaizen name and branding, Mara interface, design, code and underlying Kaizen materials remain owned by Kaizen or its licensors. You may not copy, sell or republish them unless the law permits it or Kaizen agrees in writing.
Use the service fairly.
You must not use the website or Mara to break the law, harm another person, impersonate someone, submit malware, disrupt the service, bypass security, place unreasonable automated load on the service or open another person’s plan without permission.
Kaizen may restrict access where reasonably necessary to protect people, systems or legal rights.
Third-party products can change.
The website and Mara may refer to third-party platforms, products or websites. A reference does not mean Kaizen controls or guarantees that third party.
Check current information with the provider and complete the security, privacy, legal and commercial review your business needs before adopting a product. Third-party services have their own terms and privacy policies.
Availability, consumer rights and governing law.
We may maintain, change, suspend or withdraw parts of the website or Mara. We do not promise that the service will always be available, uninterrupted or error-free. Do not rely on Mara or a Plan ID as your only business record, backup or operating system.
Nothing in these terms excludes, restricts or modifies a guarantee, condition, warranty, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.
Subject to those rights, the website and Mara are planning aids, not a promise of a particular business outcome. Kaizen is not responsible for loss that could not reasonably have been foreseen or that results from acting on unverified AI output contrary to these terms.
These terms are governed by the laws of South Australia, Australia. You and Kaizen submit to the courts of South Australia and courts that hear appeals from them.
Changes and contact.
We may update these terms when the website, Mara or applicable law changes. The updated version applies from the date shown at the top of this page. It does not alter a signed service agreement unless that agreement allows it.
